MODESTO, Calif. — Carlos Ivan Mendoza Hernandez, the man shot by U.S. Immigration and Customs Enforcement (ICE) agents, has become the center of a complex legal and ethical debate in California, particularly regarding the treatment of immigrants during enforcement actions.
The incident occurred during what ICE describes as a targeted operation. According to the Department of Homeland Security (DHS), agents opened fire after Mendoza attempted to drive towards them. However, his attorney disputes this claim, asserting that Mendoza was merely trying to avoid running them over while fleeing out of panic.
Attorney Patrick Kolasinski emphasized during a news conference that Mendoza does not have a criminal record in the United States, nor is he wanted by authorities in El Salvador where he has been acquitted of previous charges. His legal representative expressed concerns over potentially erroneous claims made by DHS regarding warrants for Mendoza.
“If he was released after being acquitted, with no other holds on him, he cannot have a warrant,” Kolasinski stated, calling for transparency in the actions of federal officials.
Dashcam footage of the incident shows Mendoza's vehicle backing up and colliding with another car before attempting to drive past agents who had weapons drawn. However, the absence of audio makes it unclear what was communicated prior to the shooting.
Mendoza's fiancée, Cindy, expressed her frustration with the situation, emphasizing that the immigration crackdown initiated during the Trump administration adversely affects families. She underscored Mendoza's character as a diligent worker who only recently made minor traffic infractions.
The ongoing investigation, now under the FBI’s purview, brings to light concerns regarding immigration enforcement tactics and the treatment of individuals involved. Kolasinski pointed out that ICE's actions could put everyone in the vicinity at risk by employing aggressive tactics.
As Mendoza remains hospitalized, awaiting clarity on his legal status and condition, his family and attorney have voiced the urgency for a fair evaluation of the event to avoid further misunderstandings and potential violations of immigrant rights.
