In brief

The sentencing of David Lee, an American businessman, to five years in prison in China for incidents dating back nearly 25 years, highlights issues of arbitrary enforcement and potential diplomatic repercussions between the U.S. and China.

A Chinese-born American businessman was handed a five-year prison sentence in China last week, due to criminal charges stemming from events nearly 25 years ago. David Lee had previously made numerous routine trips to China without incident, raising questions about the nature of his punishment. His family and human rights advocates claim that the case underscores the unpredictable and arbitrary application of law enforcement in China. In light of Mr. Lee's recent health issues, including a hospitalization where he was believed to have suffered a stroke, they have petitioned the government for his release on humanitarian grounds.Mr. Lee was found guilty of “intentional injury” and “picking quarrels and provoking trouble,” charges often deployed by Chinese authorities against those they consider a threat to public order. In the court's verdict, the judge noted that Mr. Lee had been involved in three altercations during the years 2000 and 2001, one resulting in a man's death. However, Mr. Lee's family asserts that his involvement was minimal. Having held a green card during the incidents and becoming an American citizen in 2002, Mr. Lee believed that the case had been closed, especially given his ability to travel to China nearly every month over the subsequent two decades for his work with a wholesale lighting supply business catering to companies like Home Depot. His wife, Louise Lin, expressed disbelief, saying that if he had been aware of any ongoing issues, he would not have traveled back. She now lives in California while advocating for his release and grappling with the implications of this decision amid escalating tensions between the United States and China, which have intensified due to various geopolitical factors, including economic tariffs imposed by the Trump administration.
