In a notable ruling on Thursday, a federal judge in Washington, D.C. determined that local police illegally seized a gun from Deandre Davis, criticizing the officers’ credibility and the evidence presented. U.S. District Judge Ana Reyes expressed disappointment with prosecutors for relying on the testimony of a Metropolitan Police Department officer whose credibility has been questioned by other judges.

The ruling arrives at a time when policing in D.C. faces heightened scrutiny, especially concerning officer misconduct. Judge Reyes stated that the courts cannot tolerate police officers lying under oath, underscoring the importance of maintaining public trust in law enforcement.

During the pretrial hearing, Judge Reyes barred the prosecutors from using the seized firearm as evidence against Davis, who had been arrested on firearms charges following a police encounter outside a laundromat. The judge indicated she would consider dismissing the charges if the prosecution did not withdraw the case in the coming weeks.

“It undermines the public’s confidence in our system of justice,” the judge remarked, critiquing the officer’s past testimonies and noting instances where other judges had raised similar concerns.

Prosecutor Jeanine Pirro defended the credibility of the officers involved, emphasizing that the crime had been captured on video and reiterated the need to take illegal firearms possession seriously, even for previously convicted felons like Davis. The judge cautioned Davis, stating that he should reflect on his actions and the law, as he might not receive another opportunity like this.
